Welcome to Yourenergy™ New Zealand’s on-line energy website where you can list your power and gas for free. In registering with Yourenergy™ you agree to the following terms and conditions:

1.1 Acceptance of terms and conditions: 

The terms and conditions are the terms on which Yourenergy NZ Ltd referred in this agreement as “Yourenergy™” offers you as a registered user to access to the services offered on the Yourenergy Website. By registering with Yourenergy™ you accept these terms and conditions. If you do not accept these terms and conditions, please do not proceed with registration.

1.2 Services:

Yourenergy™ provides a venue to introduce registered users who want to auction their power and gas consumption. Yourenergy™ does not take any part in the sale of energy other than by providing our Website as a venue for members who register with us. If a bid is accepted by the registered user (you), a contract of sale will be formed between the buyer and the seller directly. We do not act as agent for either party and do not participate in any sale or transaction between you and the Energy Supplier. Whilst though some of the Services are being referred to as an auction, Yourenergy™ is not an auctioneer (whether under the Auctioneers Act 2013 or otherwise).

1.3  At your own risk:

Transactions and information shared between you and suppliers bidding are conducted entirely at your own risk. You agree that Yourenergy™ takes no responsibility or liability for any misconduct of any of its registered users or suppliers including, without limitation, members that have registered under false pretenses. Yourenergy™ gives no undertakings, representations, or warranties in relation to energy services sold on the Website. We encourage you to check carefully supplier trading terms before acceptance.

1.4. Auction length:

Yourenergy™ auction length is 5 working days from listing to close. This may be extended in the event of a TOU meter where we require uploading of data from your current retailer.

1.5. After close of Auction:

Yourenergy™ will contact you immediately at the close of the auction to accept the winning bid. You have 48 hours to accept this bid. If your bid is not accepted within this time the offer is withdrawn.

1.6 Security:

We have verified your site address through your ICP provided. This is required for the supplier to verify the address to which energy is to be supplied.

1.7 Password security:

We have endeavoured to protect your identity through you having access via your own password. Please ensure that your password is protected.

1.8 Member Credit worthiness:

As part of Yourenergy™ terms and conditions, you have agreed to a payment method of either direct debit or credit card. This is for the benefit for the supplier to appease their payment terms.

1.9. Fixed Pricing Agreements:

You understand that the energy cost is the only element that can be fixed by the supplier in your auction. These are also outlined in the terms with your winning supplier. Any changes in network charges, meter fees, levies or taxes which are beyond the control of the supplier can be passed on. 2.0 REGISTERING AS A BUSINESS MEMBER

2.1  Becoming a Member of Yourenergy™: 

Registering with Yourenergy™ is free. You may only register if you are registered entity in New Zealand (eg. Company. Incorporated Society, School) and can form a legally binding contract that is enforceable against the company. By registering as a member, you warrant that you can form a legally binding contract. 

2.2  Accurate Information: 

You warrant that you have provided complete, accurate and current personal and company information when registering as a member. Yourenergy™ may phone or email you to verify these details. You must not register as a member under multiple identities or personas.

2.3 Annual Kwh consumption and Annual Value:

You agree that as a member everyone consumption profile is different. Yourenergy™ has assisted to calculate an estimated annual consumption and annual year value based on national generation data. Yourenergy™ is not liable should this be incorrect. You as a member need to review your supplier offer and make your own calculation and decision prior to acceptance.

2.4 Termination of membership:

Yourenergy™ reserves the right to decline to register or to terminate your registration without entering into further discussions with you.

Yourenergy™ has the right to change these Terms and Conditions from time to time. We will publish these changes on our website, and may choose to notify you at the contact email address that you have provided when you registered. The changes will take effect 5 working days after we publish these, or any later date that we specify.

2.6 Privacy Policy:

Yourenergy NZ Limited is committed to protecting your personal information. In doing so we deal with your personal information in accordance with the Privacy Act 1993. If we hold personal information about you, we comply with the Act. By contacting Yourenergy™ via our website, social media pages, and/or using the services provided by us, you consent to Yourenergy™ dealing with your personal information in accordance with the act.

However in accepting our terms, you (the user) agree for Yourenergy™ to disclose your details to your winning supplier (3rd party) as this is required by them to perform their function, or activity. Yourenergy™ is not liable for any information shared with your winning supplier (3rd party). Should a dispute arise between yourself and any third party due to the use of this website, we may assist you to resolve the dispute but will not be responsible for any loss or damage suffered as a result.

While we take steps to protect our user privacy, no data transmission over the internet can be entirely secure. We therefore do not guarantee the security of personal information that you send to us, or your use of our websites. Any personal information you do send is at your own risk but once we receive it we will use appropriate procedures to safeguard against unauthorised access, use, disclosure, alteration, and/or destruction of that information.
